By using Orca (“the App”), you (“the User”) agree to the following terms and conditions. If you do not agree with these terms, do not use the App.
1. USE AT YOUR OWN RISK: The App is provided “as is” and “as available” without warranties of any kind, either express or implied. The creators and maintainers of the App make no guarantees about the accuracy, reliability, or suitability of the App for any particular purpose.
2. NO WARRANTY: To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
3. RELEASE OF LIABILITY: By using the App, you agree to release and hold harmless the creators, developers, contributors, and affiliated parties from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App.
4. LIMITATION OF LIABILITY: Under no circumstances shall we be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, or the inability to use, the App, even if we have been advised of the possibility of such damages.
5. USER RESPONSIBILITY: You are solely responsible for your use of the App and any outcomes or decisions made based on its content or functionality. You agree to comply with all applicable laws in connection with your use of the App.
6. MODIFICATIONS: We reserve the right to update or modify these terms at any time without prior notice. Continued use of the App after changes constitutes acceptance of the revised terms.
7. GOVERNING LAW: These terms shall be governed by and interpreted in accordance with the laws of British Columbia and Canada.
8. CONTRIBUTOR LIABILITY RELEASE: All medical students, physicians, and other contributors who provide information, responses, or content through the App do so voluntarily and to the best of their knowledge. They are not providing formal medical advice or services through the App. By participating, such contributors are released and held harmless from any claims, damages, or liabilities arising out of or related to their contributions to the App.
By continuing to use the App, you acknowledge that you have read, understood, and agreed to be bound by these terms.
